- Provide an itemized statement and return the balance within 21 calendar days after vacancy, subject to the statutory timing rules.

For Landlords: Compliance with Security Deposit Regulations
The small-landlord exception requires both qualifying ownership and no more than two rental properties totaling four units; it cannot be used for service members. Higher-than-advertised service-member deposits have additional disclosure and return rules and remain subject to the applicable cap. Take required condition photographs, notify tenants of inspection rights where applicable, and return the remaining deposit with an itemized accounting within the statutory 21-day period. Electronic-return and multiple-adult-tenant rules also apply under subsection h.
For Tenants: Your Rights Regarding Security Deposits
Ordinary wear and tear and pre-existing defects are not deductible. You can generally request a pre-move-out inspection, although specified eviction terminations are excluded. Keep photographs, the lease and payment records. Check the itemized accounting, supporting documents and refund against § 1950.5; some documentation exceptions can be overcome by a timely request.
